Sin embargo, comprar bienes ra\u00edces en M\u00e9xico, espec\u00edficamente en lugares encantadores como Puerto Vallarta o Riviera Nayarit, puede ser un proceso sencillo si te armas con el conocimiento adecuado. Esta gu\u00eda tiene como objetivo simplificar las regulaciones inmobiliarias de M\u00e9xico para compradores extranjeros.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><strong>La Zona Restringida<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Primero, familiar\u00edzate con el t\u00e9rmino \u201cZona Restringida\u201d. La constituci\u00f3n de M\u00e9xico restringe la propiedad de tierras por parte de extranjeros a 50 km de la costa o 100 km de las fronteras internacionales. Sin embargo, no dejes que esto te desanime. Gracias a un concepto legal llamado \u201cfideicomiso\u201d, o fideicomiso bancario, los ciudadanos extranjeros pueden comprar y controlar propiedades dentro de la zona restringida.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><strong>Entendiendo el Fideicomiso<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">El fideicomiso es un fideicomiso bancario en el que el banco (el fideicomisario) posee la propiedad en nombre del comprador extranjero (el beneficiario del fideicomiso). El fideicomiso tiene una duraci\u00f3n de 50 a\u00f1os pero puede ser renovado perpetuamente. Mientras el banco posee el t\u00edtulo de propiedad, todos los derechos de propiedad, incluyendo renovaciones, alquileres y ventas, pertenecen al beneficiario del fideicomiso, es decir, al comprador de ultramar.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><strong>El rol del Notario P\u00fablico<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">En M\u00e9xico, un Notario P\u00fablico es mucho m\u00e1s que un simple certificador de documentos como es com\u00fan en muchos pa\u00edses. Son funcionarios con formaci\u00f3n en derecho, designados por el gobernador del estado, y desempe\u00f1an un papel crucial en todas las transacciones inmobiliarias. El Notario P\u00fablico es responsable de verificar el t\u00edtulo de propiedad, asegurar que no existan grav\u00e1menes sobre el inmueble, calcular y pagar los impuestos correspondientes, y registrar la escritura en el Registro P\u00fablico de la Propiedad.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><strong>Comprar a trav\u00e9s de una corporaci\u00f3n mexicana<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Una alternativa al fideicomiso es que los compradores extranjeros tambi\u00e9n pueden establecer una corporaci\u00f3n mexicana para comprar propiedades. Esto a menudo es preferido por quienes compran propiedades comerciales o que tienen la intenci\u00f3n de hacer negocios en M\u00e9xico. Sin embargo, establecer una corporaci\u00f3n implica honorarios de contadores, permisos y debe hacerse de buena fe: no se puede crear una corporaci\u00f3n \u00fanicamente con el prop\u00f3sito de comprar una casa.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><strong>Cerrar el trato<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Los gastos de cierre en las transacciones inmobiliarias en M\u00e9xico suelen oscilar entre el 5 % y el 7 % del valor de tasaci\u00f3n del inmueble, lo que incluye el impuesto de adquisici\u00f3n, los gastos de registro y los honorarios del notario. Es habitual recurrir a un servicio de custodia para garantizar la transferencia de fondos hasta que se haya completado la transacci\u00f3n.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">Si bien puede parecer complicado al principio, comprar una propiedad en M\u00e9xico como ciudadano extranjero es un camino bien transitado. Al comprender las regulaciones b\u00e1sicas, y con la ayuda de un agente inmobiliario y un Notario P\u00fablico con experiencia y reputaci\u00f3n, estar\u00e1 un paso m\u00e1s cerca de ser propietario de un pedacito de para\u00edso en lugares como Puerto Vallarta y la Riviera Nayarit.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">Recuerde que esta gu\u00eda solo proporciona una descripci\u00f3n general y que las reglas pueden variar ligeramente de un estado a otro.
